Hacking: the legal implications

Abstract The decision in the case of R v Gold [1988] 2 Alt E.R. 186 has left the computer industry to wonder why ‘hacking’, unauthorised access of computer systems, is not a criminal offence. Once again, the law seems to be defective when it comes to protecting the interests of those involved in computer technology and it is argued that the speed of development of the technology is at the heart of the problem. Technology advances faster than the law can keep up with it.
