The Law relating to Computer misuse in the Republic of Ireland

There is no specific legislation relating to computer misuse in the Republic of Ireland. To the extent that it is regulated, it is under general provisions of the criminal law, most recently in the Criminal Damage Act 1991. However, both the Law Reform Commission and the Government Advisory Committee on Fraud have made specific recommendations on the further criminalization of computer misuse. In this paper, the author considers the nature and extent of the current law relating to computer misuse in Ireland and identifies, specifically in the light of the recommendations of the Government Advisory Committee on Fraud and the Law Reform Commission, those areas which are in need of further reform.
